Testimony Continues Before Lower Macungie Zoning Hearing Board

Two Lower Macungie Township officials answered questions regarding the creation of the zoning amendment that may lead to the development of 600 acres of farmland.

Both the township manager and its chief planner testified Wednesday night regarding the development of an ordinance commissioners passed in July 2010 that may change the scenery in 600 acres of prime farmland in the southwest corner of Lower Macungie Township. Additionally, Zoning Hearing Board Chairman William Royer asked Peter Lehr, attorney for the township, to reconsider producing documents that Royer had subpoenaed and Lehr had deemed "privileged." Tempers flared at times as Lehr, Joseph Zator, attorney for Jaindl Land Co. and Donald Miles, who represents appellants Gerald and Karen Kronk, Peter H. Interest in Lower Mac Zoning Hearing Increases

Still, for all the supposed interest in preserving the township's farmland, it could be better.

Lawyer Joe Zator won a lot of technical decisions for Jaindl Land Co. at the Lower Macungie Township’s Zoning Hearing Board meeting on July 14, but he was floored when it came to predicting pubic interest. “With the number of hearings we had so far, there has been certainly no interest by the residents so far, even with the media hype,” Zator said in June as he prepared for the meeting.  “Virtually no one has been in attendance, not even appellants filing litigation.’’ But the tide may be turning. Lower Mac Zoning Hearing Board Hears First Testimony in Jaindl Case

According to some, Lower Macungie was zoned to preserve its farmland until last year.

Lower Macungie Township’s Zoning Hearing Board absorbed its first testimony in the ongoing lawsuit between Jaindl Land Co. and the group of Lower Macungie Township residents who oppose the development of about 600 acres of township farmland. The first order of business was to remove Thomas Streck and his wife, and Darlene Adonizio from the list of appellants because lawyers for both sides agreed the land they own would not be negatively affected by the proposed development, said William Royer, zoning hearing board chairman. The remaining appellants include Gerald and Karen Kronk, Peter H. Kells; Ronald and Constance Moyer; and Joseph and Kimberly Castagna. A time limited moratorium is a very wise direction twhile so many homes are for sale or rent. these proposed changes will have exrtreme impacts on the community incluidng Alburtis, Mertztown and Macungie. Poor Attendance at Lower Macungie Hearings

However, citizens may want to hear what will be said at three upcoming sessions, lawyer says.

Roe v. Wade. Brown v. Board of Education. Streck et al v. Lower Macungie Township and Jaindl Realty. The case hasn’t yet reached  the Supreme Court, but some involved in the Jaindl  controversy would like to see it heat up to supreme levels in coming weeks. The object would be to have the public crash the doors of the hearing room demanding zoning officials to “Save our farms!” The dispute stems from the agreement between Orefield-based Jaindl and the township to develop  600-plus acres of mostly farmland into 4 million square feet of warehouses, 700 homes, a  443,000-square-foot shopping center, a convenience store with 16 gasoline pumps and a sit-down restaurant.
